FURTHERMORE, BY CLICKING “I AGREE” OR INDICATING ACCEPTANCE, YOU GRANT AUTHORITY TO ANY PARTY TO ACT ON YOUR BEHALF.

ARBITRATION NOTICE: UNLESS YOU OPT OUT OF ARBITRATION AS PER THE INSTRUCTIONS PROVIDED WITHIN THESE TERMS AND CONDITIONS, YOU CONSENT TO THE RESOLUTION OF DISPUTES BETWEEN YOU AND US OR YOU AND THE MEDICAL GROUPS OR PROVIDERS THROUGH BINDING, INDIVIDUAL ARBITRATION. THIS WAIVES YOUR RIGHTS TO A JURY TRIAL AND PARTICIPATION IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION, AS FURTHER DETAILED BELOW. EXCEPTIONS AND PROCEDURES FOR OPTING OUT OF ARBITRATION ARE EXPLAINED BELOW.

IN CASE OF A MEDICAL EMERGENCY, SEEK IN-PERSON EMERGENCY CARE IMMEDIATELY OR DIAL 911. PLEASE BE AWARE THAT THE SERVICE MAY NOT BE SUITABLE FOR ALL MEDICAL CONDITIONS OR CONCERNS. THIS AGREEMENT IS SUBJECT TO MODIFICATIONS, AS ELABORATED HEREIN.

Welcome to the IAM HRT Health & Wellness Platform (“IAM,” “we,” or “us”). By accessing and using our website located at https://iamhrt.com and/or our associated applications (collectively, the “Platform”), you confirm your consent to the following Terms and Conditions (“Agreement”).

Utilization Conditions

Your use of the Platform, encompassing all content, products, services, or applications offered through IAM or its affiliates, is contingent upon these Terms and Conditions. The terms “you” and “yours” pertain to users of the program or service, denoted as the “Patient.”

Prescription Management

We collaborate with 1st Choice Pharmacy (“Pharmacies”), LabCorp, and occasionally Quest Diagnostics (“Labs”). You acknowledge that your prescriptions may be transferred between the Pharmacies for fulfillment, facilitated by the Service on your behalf.

Medical Groups and Providers

Through the Platform, you may access healthcare services provided by Medical Groups consisting of physicians, allied and health professionals (“Providers”). We do not intervene in the medical practices of Medical Groups or Providers, as they exclusively oversee your medical care and treatment.

Telehealth Consent and Privacy

You grant consent for remote healthcare consultations and/or treatment when utilizing our Telehealth services. Your personal health information (“PHI”) enjoys protection in line with the Health Insurance Portability and Accountability Act (“HIPAA”). It’s important to acknowledge that electronic communications carry inherent risks.

No Guarantees

We make no assurances about the outcomes of services rendered through IAM or its Medical Groups. Medical care and results may exhibit variability.

Prohibited Use

Engaging in illegal, harmful, or abusive activities on the Platform is strictly prohibited. We retain the right to terminate services in response to such conduct.

Site Registration

Access to specific features may necessitate registration on IAM’s site or via the third-party service provider Tebra. Registration details should be accurate and updated.

Refunds and Limitation of Liability

Due to the nature of pharmaceutical products, no refunds are available for medications. We bear no liability for damages arising from your use of the Platform; your usage is at your own discretion.

Indemnification

You commit to indemnifying and absolving IAM, Management, and associated entities from any claims, losses, or damages stemming from your use of the Platform.

Notices and Electronic Communications

You consent to receive electronic communications from IAM. Notices and updates will be delivered via email or posted on the Platform.
